To ensure your holiday meets your full satisfaction, we have established all necessary prerequisites, including clear legal rules outlined below.
The following provisions, to the extent they are validly agreed, form part of the travel contract concluded between the customer and the tour operator. They complement the statutory provisions of §§ 651a - m of the German Civil Code (BGB) and the information requirements for tour operators under §§ 4 - 11 BGB-InfoV (Regulation on information and documentation obligations under civil law) and elaborate on them:
1. Conclusion of the Travel Contract
1.1 By registering, the customer makes a binding offer to REISEfreudig to conclude a travel contract. Registration may be made in writing, verbally, by telephone, or by other means of remote communication. The registrant also acts on behalf of all participants listed in the registration, who are jointly responsible for the contractual obligations if a corresponding separate obligation has been explicitly assumed.
The contract is concluded upon acceptance by the tour operator. Acceptance does not require a specific form. Upon or immediately after conclusion of the contract, the tour operator will provide the customer with a travel confirmation. If the content of the confirmation differs from the registration, this constitutes a new offer by the tour operator, binding for 3 days. The contract is concluded on the basis of this new offer if the traveler accepts it within the binding period.
2. Payment
2.1 Tour operators and travel agents may only request or accept payment for the travel price before the start of the trip if the customer has received a security certificate. After concluding the contract, a deposit of 10% to 30% per person of the travel price is due upon receipt of the security certificate. The remaining travel price must be paid between the 60th and 20th day before departure, provided the security certificate has been issued and the trip cannot be canceled for the reasons specified in Section 7.1. The exact due date is specified in the booking confirmation. Without full payment, the customer has no claim to use the travel services.
2.2 If the trip lasts no longer than 24 hours, does not include an overnight stay, and the travel price per customer does not exceed €75, payments may be requested without a security certificate.
2.3 If the customer does not pay the deposit and/or the remaining amount on time, REISEfreudig is entitled to withdraw from the travel contract after issuing a reminder and setting a deadline, charging the customer cancellation fees according to Sections 4.2–4.5.
3. Changes to Services
3.1 Changes to essential travel services after conclusion of the contract that are necessary and not caused by bad faith by REISEfreudig are only permitted if the changes are not significant and do not affect the overall character of the trip.
3.2 Any claims for defects remain unaffected if the changed services are defective.
3.3 REISEfreudig is obliged to inform the customer immediately of any significant changes once aware of the reason.
3.4 In the event of a significant change to an essential service, the customer may withdraw from the contract free of charge or request participation in a comparable trip, if REISEfreudig can offer such a trip without additional cost. The customer must assert these rights immediately after being informed of the change or cancellation.
4. Cancellation by the Customer / Cancellation Fees
4.1 The customer may withdraw from the trip at any time before departure. Withdrawal must be declared to REISEfreudig or, if booked through a travel agency, to the agency. Written declaration is recommended.
4.2 If the customer withdraws or does not start the trip, the tour operator loses the claim to the travel price. Instead, the operator may demand reasonable compensation for arrangements already made and expenses incurred, unless the withdrawal is due to the operator’s fault or force majeure.
4.3 REISEfreudig calculates this compensation on a sliding scale based on the timing of withdrawal relative to departure:
Up to 31 days before: 20%
30–15 days: 50%
14–8 days: 70%
7–3 days: 80%
Day of departure / no-show: 90%
The customer may demonstrate that REISEfreudig incurred no or significantly lower damage.
4.4 REISEfreudig may demand higher actual compensation instead of the standard fees, considering saved expenses and possible alternative use of services.
5. Rebooking
5.1 There is no right for the customer to change travel dates, destination, departure point, accommodation, or transport type. If a change is made upon request, a fee of €15 per person applies.
5.2 Requests made after deadlines may only be accommodated after cancellation and new registration, except for minor cost-neutral changes.
6. Unused Services
If the customer does not use individual services for which they are properly offered, they are not entitled to a partial refund. REISEfreudig will attempt reimbursement from service providers. This obligation does not apply to negligible services or where statutory rules prevent reimbursement.
7. Withdrawal due to Minimum Participation Not Met
REISEfreudig may withdraw if the minimum number of participants is not reached, provided it was specified in the travel description and confirmation, and notice is given no later than 14 days before departure. Payments will be refunded immediately if the trip is canceled for this reason.
8. Termination for Behavioral Reasons
REISEfreudig may terminate the contract immediately if the customer persistently disrupts or behaves contractually incorrectly, retaining the right to the travel price but accounting for saved expenses and benefits from alternative use.
9. Customer Obligations
9.1 Complaints must be reported immediately to REISEfreudig. Failure to report may affect price reductions.
9.2 The customer must allow a reasonable period for remedy unless impossible or refused.
9.3 Baggage loss or delay must be reported immediately using a P.I.R. claim.
9.4 The customer must notify REISEfreudig if travel documents are not received on time.
9.5 The customer must minimize damage and alert REISEfreudig to risks.
10. Limitation of Liability
10.1 Liability for non-personal damages is limited to three times the travel price, except in cases of intentional or gross negligence.
10.2 Liability for property damage under tort law is limited to three times the travel price per customer and trip.
10.3 REISEfreudig is not liable for services provided by third parties unless clearly indicated in the description.
11. Claims and Limitation Periods
11.1 Claims for non-contractual performance must be made within one month after the contractually agreed end of the trip.
11.2 Claims under §§ 651c–651f BGB expire after one year.
11.3 Baggage loss claims: 7 days; delay: 21 days.
12. Information on the Operating Airline
Tour operators must inform the customer about the operating airline for all flights booked. Updates must be communicated immediately if the airline changes.
13. Passport, Visa, and Health Regulations
13.1 EU citizens will be informed about relevant regulations. Non-EU citizens must check with their consulate.
13.2 The customer is responsible for documents, vaccinations, customs, and currency regulations.
13.3 The tour operator is not liable for delays in visa issuance unless caused by its own fault.
14. Governing Law
German law exclusively applies to the contract and its legal consequences.
15. Jurisdiction
15.1 The customer may only sue REISEfreudig at its registered office.
15.2 For claims by REISEfreudig against the customer, the customer’s residence applies.
15.3 Exceptions apply if non-derogable international or EU rules are more favorable to the customer.
